If the court has authorized release and an eligible surety bond is required, call (480) 398-6115 for assistance anywhere in Arizona.

DOES A DOMESTIC VIOLENCE ARREST REQUIRE A BAIL BOND?

AFTER A DOMESTIC VIOLENCE ARREST

Not every domestic violence arrest results in the same release decision.

A defendant may be released under conditions without having to post a monetary bond, or the court may require bail before release. Arizona law allows someone arrested for domestic violence to be released under the Arizona Rules of Criminal Procedure and other applicable law, but any release order must include conditions necessary to protect the alleged victim and other specifically designated people.

If the court has set a monetary bond and permits release through a surety bond, Apex can help with that bond.

HAS A DOMESTIC VIOLENCE BOND BEEN SET?

If you know where the defendant is being held and a monetary bond has already been set, call Apex with the defendant's information and bond amount. We'll explain what is required to start an eligible surety bond.

STILL WAITING FOR RELEASE INFORMATION?

If the arrest just occurred, booking may still be underway or the defendant may be waiting for the court to determine release conditions. You can call Apex with the information you have while you wait for additional details.

HOW A DOMESTIC VIOLENCE BAIL BOND WORKS

FROM ARREST TO RELEASE
Domestic violence cases can involve additional release conditions, but the bail bond itself follows a straightforward process once the court permits release on a surety bond.
01

ARREST & BOOKING

The defendant is taken into custody and processed by the appropriate detention facility.
02

THE COURT DETERMINES RELEASE

The judicial officer determines whether the defendant is eligible for release and what conditions will apply. In determining release or bail, Arizona law specifically allows consideration of a domestic-violence risk or lethality assessment when one is presented to the court.
03

CONFIRM THE BOND

If monetary bail is required, confirm the bond amount and whether it can be satisfied through a surety bond.
04

CALL APEX

Provide the defendant's information, detention location and available bond details.
05

COMPLETE & POST THE BOND

Apex explains the bail bond requirements and paperwork and posts the eligible surety bond with the appropriate facility.
06

RELEASE PROCESSING BEGINS

After the bond is accepted, detention personnel complete their release procedures and verify that any other holds or requirements have been addressed.

DOMESTIC VIOLENCE CASES CAN INVOLVE MISDEMEANOR OR FELONY CHARGES

DOMESTIC VIOLENCE IS A DESIGNATION

Seeing “domestic violence” on a booking record doesn't by itself tell you whether the underlying charge is a misdemeanor or felony.

Arizona's domestic-violence statute applies the DV designation to specified underlying offenses when the required relationship exists. The classification generally comes from the underlying offense itself.

Arizona also has a separate offense of Aggravated Domestic Violence. Under current law, aggravated domestic violence under §13-3601.02 is a Class 5 felony when the statutory requirements involving qualifying prior domestic-violence offenses are met.

From the bail bond perspective, Apex needs to know:
‍Where is the defendant being held?
Has release been authorized?
Has a monetary bond been set?
Is a surety bond permitted?

HOW IS BAIL DETERMINED IN A DOMESTIC VIOLENCE CASE?

EVERY RELEASE DECISION IS INDIVIDUAL

There isn't one automatic Arizona bail amount for every domestic violence arrest.

When determining the method of release or amount of bail, Arizona law directs the judicial officer to consider numerous factors, including the views of the victim, circumstances of the alleged offense, criminal history, potential danger to others, court-appearance history and, when presented, the results of a domestic-violence risk or lethality assessment.

‍Apex does not determine the bond amount, the court does.

‍
Once a monetary bond has been established and surety release is available, call us and we'll explain what is required for the bail bond.

ARIZONA DOMESTIC VIOLENCE BAIL BOND FAQS

DOMESTIC VIOLENCE BAIL QUESTIONS

After a domestic violence arrest, questions about custody and release can get mixed together with questions about the criminal case. These answers stay focused on bail and release.

CAN SOMEONE GET BAIL AFTER A DOMESTIC VIOLENCE ARREST?

Depending on the circumstances, yes. Arizona law provides for release in applicable domestic-violence cases under the Rules of Criminal Procedure and other applicable law, with protective release conditions required.

DOES EVERY DOMESTIC VIOLENCE ARREST REQUIRE A BAIL BOND?

No. Whether monetary bail is required depends on the court's release determination. Some defendants may be released under conditions without needing a surety bond.

IS DOMESTIC VIOLENCE ALWAYS A FELONY IN ARIZONA?

No. Arizona's domestic-violence designation can apply to various underlying offenses. Those offenses can have different classifications. Arizona also separately defines Aggravated Domestic Violence as a Class 5 felony when the statutory requirements are satisfied.

CAN SOMEONE RETURN HOME AFTER BONDING OUT?

That depends on the actual release orders issued by the court. A bail bond does not override a no-contact order or other restriction. Apex cannot interpret those orders; the defendant should consult their attorney or the court about what is permitted.

DOES POSTING BAIL REMOVE A NO-CONTACT ORDER?

No. Posting the bond and complying with court-ordered release conditions are separate requirements.

CAN THE COURT PUT ADDITIONAL CONDITIONS ON RELEASE?

Yes. Arizona law permits several types of release conditions, and domestic-violence cases have specific victim-protection requirements.

HOW LONG DOES RELEASE TAKE AFTER A DOMESTIC VIOLENCE BOND IS POSTED?

There is no single statewide release time. The detention facility must process the bond and complete its release procedures, and additional holds or court requirements can affect timing.

WHAT INFORMATION SHOULD I HAVE WHEN I CALL?

Start with the defendant's full legal name and date of birth. If available, also have the arrest location, jail, booking number and bond amount. Don't wait to call simply because you're missing one of those details.

DOES APEX HANDLE DOMESTIC VIOLENCE BAIL BONDS THROUGHOUT ARIZONA?

Yes. Apex provides eligible domestic violence bail bond assistance throughout Arizona. Call (480) 398-6115 24 hours a day.
